  1. About these Terms

These Terms of Service ("Terms") govern your use of the Potent Clarity website (www.potentclarity.com.au), the Claim Pulse tool, and the Insurance Claim Delay Rescue Kit (together, the "Services"), provided by Jacki James trading as Potent Clarity (ABN: 67110557619, "Potent Clarity", "we", "us", "our").

By using this website, completing Claim Pulse, or purchasing the Rescue Kit, you agree to these Terms. If you don't agree, please don't use the Services.

Our Privacy Policy explains how we handle personal information and forms part of these Terms by reference.

  1. What Potent Clarity is - and isn't

Potent Clarity provides educational and organisational tools to help policyholders understand and manage their own insurance claims. Nothing in the Services constitutes legal advice, financial advice, or personal claims advice, and nothing in the Services should be relied on as a substitute for professional advice specific to your situation.

Claim Pulse is an educational tool. It identifies patterns in how a claim is being handled based on your responses. It does not assess your policy, predict outcomes, or constitute personal claims advice.

The Rescue Kit is an educational and organisational framework. It helps you organise your claim, understand your situation more clearly, and communicate more effectively with your insurer. It does not replace legal or financial advice.

Using the Services does not guarantee any particular outcome in relation to your insurance claim, including (without limitation) claim approval, timing, or the amount payable. Every claim is different, and outcomes depend on facts and circumstances outside our control.

If your situation involves complex legal questions or significant financial exposure, we recommend seeking independent professional advice.

  1. Claim Pulse

Claim Pulse is a free tool that generates a personalised result based on your responses to a short set of questions.

•     Claim Pulse is provided free of charge and does not require purchase of the Rescue Kit.

•     We collect your email address to send you your full results and related content. See our Privacy Policy for how this information is handled, and the Claim Pulse opt-in for how to unsubscribe at any time.

•     Results are generated from patterns in your responses only. We do not review your actual claim file, policy documents, or correspondence with your insurer as part of Claim Pulse.

  1. The Rescue Kit

•     The Insurance Claim Delay Rescue Kit ("Rescue Kit") is a paid digital product comprising five tools: Quick Start Guide, Delay Decoder, Momentum Tracker, Clarity AI Prompt Library, and Orientation Guide.

•     On purchase, you receive instant access to a digital download page containing the current version of the toolkit.

•     Licence: purchasing the Rescue Kit grants you a personal, non-exclusive, non-transferable licence to use the toolkit for your own insurance claim(s). You may not resell, redistribute, share, sub-license, or publish any part of the Rescue Kit, in whole or in part, without our prior written consent.

•     All content, templates, frameworks, and materials in the Rescue Kit remain the intellectual property of Potent Clarity (see clause 11).

  1. Payment

•     Prices are listed in Australian dollars (AUD).

•     Payments are processed securely by Stripe. We do not store your full payment card details.

•     Potent Clarity is not currently registered for GST.

•     Because the Rescue Kit is a digital product delivered instantly on purchase, once you've accessed the download page, standard change-of-mind refund rights don't automatically apply — our Satisfaction Guarantee below sets out your options.

  1. Satisfaction Guarantee

We want the Rescue Kit to actually help. If you work through the Quick Start Guide and don't feel clearer about your claim and more confident about your next step, email hello@potentclarity.com.au within 14 days of purchase.

We'll work with you to make it right — this may include a refund, credit, additional support, or another resolution appropriate to your situation, at our discretion. Nothing in this guarantee limits any rights you have under the Australian Consumer Law (see clause 9).

  1. Using AI tools with the Clarity AI Prompt Library

The Clarity AI Prompt Library provides prompts designed for use with third-party AI tools (such as ChatGPT or similar services). Potent Clarity is not affiliated with, and is not responsible for, the outputs of any third-party AI tool. AI-generated content can be inaccurate or inappropriate for your specific situation.

You are responsible for reviewing any AI-generated content carefully before relying on it or sending it to your insurer or any other party. Use of AI tools referenced in the Rescue Kit is entirely optional.

  1. No affiliation

Potent Clarity is an independent business. We are not affiliated with, endorsed by, or acting on behalf of any insurer, the Australian Financial Complaints Authority (AFCA), or any other regulator, ombudsman, or dispute resolution body. References to AFCA, industry codes of practice, or claim-handling timeframes are provided for general educational context only.

9. Your rights under the Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded, restricted, or modified. Where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited (at our option) to resupplying the Services or paying the cost of having the Services resupplied.

10. Limitation of liability

To the maximum extent permitted by law, and subject to clause 9:

•     Potent Clarity's total liability arising out of or in connection with the Services is limited to the amount you paid for the Rescue Kit (if applicable).

•     We are not liable for any indirect, consequential, or special loss, including loss of income, loss of claim proceeds, or loss arising from decisions you make in relation to your insurance claim.

•     The Services are provided "as is." We don't warrant that the Services will be error-free, uninterrupted, or suitable for your particular circumstances.

11. Intellectual property

All content on the Potent Clarity website and within Claim Pulse and the Rescue Kit — including text, templates, frameworks, tool designs, and branding — is owned by Jacki James trading as Potent Clarity, or used under licence, and is protected by copyright and other intellectual property laws. Except as expressly permitted under clause 4, you may not reproduce, distribute, modify, or create derivative works from this content without our prior written consent.

12. Governing law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Services are subject to the exclusive jurisdiction of the courts of Queensland.

13. Changes to these Terms

We may update these Terms from time to time, including to reflect changes to our Services, pricing, or legal requirements. Updated Terms take effect from the date they're posted on this page. Continued use of the Services after changes take effect means you accept the updated Terms.
